Article 1. Vendor

Pepatino will hereafter be referred to as 'the Vendor' is registered with the Belgian 'Kruispuntbank der Ondernemingen' under number 0892.804.133. The VAT number is BE 0892.804.133.

Article 2. Sales agreement

A sales agreement exists between Pepatino and the adult client (the 'Purchaser') from the moment that the order confirmation appears on the purchaser's screen. Everyone who places an order with Pepatino confirms that they agree to the purchase conditions.

Electronic evidence (e.g. – email, backups) will be accepted by all involved parties within the framework of the purchase agreement and clients.

Article 3. Ordering

By ordering with Pepatino you agree to comply with the purchase, delivery and payment conditions.

Article 4. Prices and product information

All of our prices are in euros, include 21% VAT and are exclusive of postage charges. All prices apply to a single item unless otherwise stated. Postage charges are clearly stated separately. The price and offer of an order are always those which apply at the moment of ordering. Pepatino retains the right to change and amend product pricing and information. If shortly after purchase a product appears to be reduced in price, no claim can be made for repayment of the price difference.

Pepatino aims to provide product description and photographs that are as clear and correct as possible. Information about items (e.g. – sizes and materials) is only an indication and colours within photographs may vary from the actual colour. If items are smaller or larger than usual, then this is stated in the size of the option on the site. You can always find additional information about our offers by contacting us.

Article 5. Payment

Pepatino operates a secure payment environment together with its partner Ogone. This payment platform is integrated into the Pepatino online shop. Payment is via credit card (Visa or MasterCard), via Bancontact/Mister Cash, via online banking (KBC, ING or Dexia) or by direct transfer. Further information about Ogone can be found on www.ogone.be.

5.1. Visa/MasterCard

Payment by credit card (Visa or MasterCard) is free to the client and fast. Payment is immediately registered and we can then send out the order immediately.

5.2. Payment Bancontact/Mister Cash

You can also pay with a Bancontact or Mister Cash card. From our site you will be connected to the Ogone site, where you can enter your details. The amount will immediately be deducted from your account and Pepatino can then begin to prepare your order ready for posting.

5.3. Payment via online banking (KBC/ING/Dexia)

You can also pay by using our trusted internet banking formula. Pepatino offers you the chance to make the money directly over to our account by using KBC, ING or Dexia online banking. This way of paying also ensures a direct money transfer, meaning that the order can be sent out just as quickly.

5.4. Money transfer

The final payment method is a direct money transfer. Following your order, Pepatino will send you an order confirmation via email in which the necessary details are stated. We request that you credit the total amount, as stated on the order confirmation, within 10 days to our account 001-5357000-57, stating the order number. Your package will be sent out to you following receipt of your payment, and usually within 1 working day. A longer delivery period is required for items only deliverable upon order. Orders will be reserved for 10 days. If payment is not received by this time, you will receive a reminder message by email. If there is no reaction to this email within 3 days then the ordered items will be returned for sale and the order will be cancelled.

NOTE: If you carry out an international transfer, please always include our BIC (SWIFT) and IBAN details (you will find these on your order confirmation!) If you don’t do this then your bank will apply extra charges for which we are not responsible. If you state the BIC and IBAN details then a transfer from within other European countries is free. Article 6. Delivery and postage

6.1. Delivery

Pepatino tries to ensure the fastest possible delivery. In 6.2, Delivery period, we give an indication of our delivery periods. These periods are not binding and should be viewed only as an indication. Pepatino can accept no responsibility for delays resulting from third parties.

The Purchaser supplies Pepatino with the delivery address. If this address appears to be incorrect, then this falls under the responsibility of the Purchaser and extra charges will be brought.

In the event of non-delivery of goods, any amount paid by the Purchaser will be credited without interest or other compensations.

6.2. Delivery period

For Belgium: as soon as we have received your payment, we will get your package ready for sending. Within 1 or 2 business days after receipt of your payment, we will send your package, using parcel post (Kilopost). The package will then be delivered to your door within 3 business days after receipt of payment. If you are not home at the time of delivery, you will receive a written notification and you will be able to pick up the parcel at the post office.

For the Netherlands or Luxembourg: as soon as we have received your payment, we will get your package ready for sending. Within 1 or 2 business day after receipt of your payment, we will send your package, using parcel post (TNT Post). The package will be delivered to the door by TNT Post, within 3 business days. If you are not home at the time of delivery, you will receive a written notice in your mailbox and your package will be offered again on the next business day. This is done twice. After this, you can pick it up yourself from the post office.

Rest of Europe: as soon as we have received your payment, we prepare your package to send it. Within 1 or 2 days after having received your payment, we send your package using package posting (Taxipost). Taxipost will deliver the package at your home, within 6 working days. When you are not at home at the time of delivery, you will receive a written notification in your post box and you will be able to collect the package in your post office. If you want, you can also send the package to your work address or to a neighbour.

Rest of the World: as soon as we have received your payment, we prepare your package to send it. Within 1 or 2 days after having received your payment, we send your package using package posting (Taxipost). Taxipost will deliver the package at your home, within 10 working days. When you are not at home at the time of delivery, you will receive a written notification in your post box and you will be able to collect the package in your post office. If you want, you can also send the package to your work address or to a neighbour.

Pepatino can not be held responsible for delays resulting from postage by De Post (Kilopost or TNT Post). In accordance with the law ‘distance selling’ has a maximum delivery period of 30 days unless otherwise agreed. If this delivery period is not achievable, then Pepatino will make the Purchaser aware of this in writing and the Purchaser has the right to cancel without additional charges. In this event, any amounts already paid will be credited within 30 days.

6.3. Postage costs

We retain the right to change our postage tariffs if necessary. Postage charges are clearly stated on your order confirmation and on your invoice.

6.3.1. Belgium

Orders over 100 euros qualify for FREE postage. Orders below this amount incur a 4.50 euro postage charge.

6.3.2. The Netherlands & Luxemburg

Orders over 100 Euros qualify for FREE postage. Orders below this amount incur a 6.20 Euro postage charge.

6.3.3. The rest of Europe

Orders over 100 Euros qualify for FREE postage. Orders below this amount incur a 9.00 Euro postage charge.

6.3.4. Other

Please contact us if you wish to send a package to another country. We’d be pleased to help you further.

Article 7. Complaints and return/exchange of purchased items

7.1.

If you are unhappy about your purchase or if an item is damaged on arrival, then we offer you the chance to send the item back to us within a period of 10 business days from receiving your order. You must inform us of this in writing (via e-mail to: info@pepatino.be). The item must be returned within 10 business days in the original packaging, and must be undamaged and unused. It must also have sufficient postage and be sent along with the invoice and an accompanying letter. Returned packages that we have not been notified of or which do not have sufficient postage, will not be credited! Items bought during the sale period cannot be returned.

7.2.

Items returned to us under the conditions described in point 7.1 will be credited by us within a period of 10 working days. Postage charges incurred by either you or us will not be credited, meaning that you will be credited with the purchase price minus the postage charges. If it concerns an item that was incorrectly delivered by Pepatino, then we will assume responsibility for postage charges.

7.3.

We retain the right to refuse returns if we suspect that the items have been used or damaged by anyone other then Pepatino or the party who delivered the item.

7.4.

We check our items before we send them out and ensure quality packaging. The client agrees to check the order at the point of delivery. Never accept packages that are clearly damaged through transportation, and check your shipment immediately upon receipt! We check every shipment before it leaves us. If you do find any damage to the items delivered to you, we request that you make us aware of this immediately. If possible, we request that you email a photograph of the damaged item. Never dispose of the packaging before ensuring that your shipment is in a good condition and never send a package back to us without informing us of this beforehand!

7.5.

If you have a complaint, just send us an email (info@pepatino.be). Each complaint is dealt with seriously, and we aim to find a mutually satisfactory solution.

Article 8. The right to refuse

As a consumer you have the right to inform us that you are cancelling the purchase (legal stipulations in connection with ‘distance selling’ stated in the law of 14 July 1991), without payment and without a fine or other indication of motive, within 7 business days from the day following the day of the delivery. If you want to use this right, you must return the goods at your own risk and cost to Pepatino, Diepestraat 130, 9300 Aalst.

Article 9. Privacy

Pepatino uses cookies. Cookies consists of a standard internet technology that makes it possible to save and open certain information on the system of the user. Cookies cannot be used to identify individuals; a cookie can only identify a machine. Any internet user can set up his computer in such a way that cookies will not be accepted. If your computer does not accept cookies, you might encounter some difficulties during the ordering procedure. If this is the case, please contact us so that we can still enter your order.

Ordering at Pepatino requires you to give us your customer data. Pepatino uses this information for the administration of your order, management of orders, deliveries and invoices, tracking payments and, finally, for marketing and advertising purposes, if you have given us permission for the latter during the ordering process. You also always have the right to forego the advertising and marketing promotions. Your information will not be passed on, rented or sold to any third parties. As Buyer you are always entitled to insight and correction of this data. At your request (please send us an email for this) Pepatino will delete your data from our database. Article 10. Ownership

Pepatino remains the owner of a purchased item up until the moment at which the sale price is fully paid.

Article 11. Distinction

If any article of these terms should be declared null and void, then this non-validity shall not influence the validity of the remaining articles.

Article 12. Applicable law

All agreements between Pepatino and the client are subject to Belgian law. The Belgian courts are the sole authority.
